Terms & Conditions

Effective Date: January 1, 2025

These Terms & Conditions constitute a legally binding contract between you and Cargo Matters. This Agreement is governed under the Indian Contract Act, 1872, and other applicable laws of the Republic of India.

These Terms & Conditions ("Agreement") are a legally binding contract between you ("Client", "User", or "Customer") and Cargo Matters ("Company", "we", "us", or "our"). By using our website or services, you agree to these terms in full.

1. Scope of Services

Cargo Matters provides logistics, cargo transport, freight forwarding, warehousing, and related support services throughout India and internationally, subject to availability and compliance with legal requirements.

2. User Obligations

You agree to:

  • Provide accurate shipment and payment information
  • Ensure cargo is lawful and not restricted or prohibited under Indian customs or transportation laws
  • Refrain from misusing the platform or engaging in fraudulent or illegal activities

Prohibited cargo includes but is not limited to: explosives, narcotics, counterfeit goods, live animals, and perishable items unless specifically agreed upon.

We reserve the right to refuse or cancel shipments that violate any law or our internal risk policies.

3. Payments, Fees & Charges

  • All payments are due as per the invoice terms.
  • Interest @18% per annum will be charged on delayed payments.
  • We reserve the right to suspend services or initiate legal proceedings for non-payment.
  • All taxes (including GST) are to be borne by the customer.

4. Cancellation & Refund Policy

  • Cancellation must be requested in writing at least 24 hours before scheduled pickup.
  • Refunds, if any, will be issued at the sole discretion of Cargo Matters and are subject to deductions for administrative or handling costs.
  • No refunds for services already rendered or once cargo is in transit.

5. Limitation of Liability

Cargo Matters shall not be liable for:

  • Delays or damages caused by third-party carriers, customs, strikes, weather, or force majeure
  • Loss or damage due to improper packaging or labeling by the client
  • Any indirect, incidental, or consequential losses

Maximum liability is limited to INR 50,000, unless additional insurance coverage is purchased and documented.

6. Insurance

We offer optional cargo insurance at an extra cost. If insurance is declined, Cargo Matters shall not be held liable for any damage, theft, or loss during transit.

7. Intellectual Property

All content, logos, images, and materials on the Cargo Matters website are owned or licensed by the Company. Unauthorized use or reproduction is strictly prohibited.

8. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cargo Matters, its directors, and employees from and against all claims, damages, or expenses arising from:

  • Breach of this Agreement
  • Violation of applicable laws
  • Any third-party claims related to the cargo

10. Amendments

We reserve the right to update these Terms & Conditions at any time. Continued use of our services after such updates constitutes acceptance of the revised terms.
